Terms and Conditions for Whisker Tracker

Welcome to Whisker Tracker! These Terms and Conditions (“Terms”) govern your use of the Whisker Tracker application (“App”) provided by Animal Cause Marketing LLC (“Company”, “we”, “us”, “our”). By downloading, accessing, or using our App, you explicitly agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1. Acceptance of Terms

By creating a user profile, uploading content, or otherwise interacting with the App, you explicitly agree to comply with and be bound by these Terms and our Privacy Policy.

2. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information.
• Protect your account credentials and not share them with others.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to terminate or suspend your account if any information provided is found to be inaccurate or incomplete or if you violate any terms.

3. User Content

Users can upload and take pictures of cats and interact with other users. By submitting content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, store, display, reproduce, save, modify, create derivative works, perform, and distribute your content on and through the App. This license ends when you delete your content or your account unless your content has been shared with others and they have not deleted it.

Protection of Cats’ Locations

We understand the importance of protecting the locations of cats for their safety. To this end:

• We are committed to ensuring that no harm comes to cats as a result of the use of our App. Our systems are designed to safeguard the privacy and security of the cats’ locations.
• The precise locations of cats will be protected and will not be publicly visible or shared with other users or third parties without your explicit consent.
• Explicit consent refers to a clear affirmative action taken by the user, such as ticking a box or clicking ‘I agree’ in response to a specific request, indicating their agreement to share precise location data. Without such consent, precise locations will not be shared.

4. Privacy and Data Collection

We are committed to protecting your privacy and the privacy of the cats’ locations. Our data collection practices include:

• Collecting location and time data for pictures you take or upload.
• Using this data to enhance user interactions and experiences within the App.
• Not sharing precise location data of cats with third parties without your explicit consent.

5. Subscriptions

Whisker Tracker offers subscription plans that provide additional features and benefits. Subscription terms, including billing and cancellation policies, will be provided at the time of purchase. By signing up for a subscription, you agree to pay all applicable fees and charges for your subscription. Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscriptions through your account settings.

6. User Feedback

We welcome your feedback on our App. By submitting feedback, you grant us the right to use and incorporate your feedback without any obligation to you.

7. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Post content that is offensive, inappropriate, or violates any laws or regulations.
• Interfere with or disrupt the App or servers/networks connected to the App.

8. Intellectual Property

All intellectual property rights in the App and its content, features, and functionality are owned by the Company or its licensors. You agree not to copy, modify, distribute, sell, or lease any part of our App or included software.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

10. Limitation of Liability

To the maximum extent permitted by law, Animal Cause Marketing LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein, except in cases of gross negligence or willful misconduct.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of any significant changes by email or through the App. You are advised to review these Terms periodically for any changes. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of California, USA, without regard to its conflict of law provisions.

14. Disputes Resolution

If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting the Company. Please email us at [email protected]. We will attempt to resolve the dispute through good faith discussions within 30 days of your notice. If the dispute cannot be resolved informally, it may be escalated to arbitration or court proceedings as governed by the laws of California, USA.
